Adventure Circus terms and conditions

At Adventure Circus we want to make sure that you enjoy taking part in circus activities in a safe and secure environment. Your welfare is of paramount importance to us and we take steps to ensure we meet industry requirements.

By booking into our classes and paying the appropriate fee, you accept and agree to abide by these terms and conditions.

Insurance

We have been assessed and have £5million public liability insurance and £10million liability insurance with hencilla.co.uk which covers all of our instructors. You can see our insurance cover certificate on the blue noticeboard, in our training space. As a participant, we recommend that you purchase a policy that will cover you for personal injuries, and subsequent loss of earnings, should you be injured while taking part in our activities.

Working at heights

Our facility has been assessed by structural engineers McGregor McMahon Ltd. All of our equipment has been purchased through reputable climbing and aerial activity suppliers and is catalogued for inspections every 6 months. All of our equipment is rigged by a working at heights and aerial rigging qualified professional and checked by Adventure Circus instructors who have achieved an aerial rigging certification.

Readiness to participate

Our physical activity readiness questions below are designed to help you assess your ability to take part in our activities. There are many health benefits associated with regular exercise and the completion of a questionnaire is a sensible first step to take if you are planning on increasing/changing the type of physical activity in your life. Common sense is your best guide in answering these few questions. Please read them carefully. If you answer yes to any of the questions, we recommend that you seek advice from your GP and discuss with our instructors before booking and attending classes.

• Do you frequently have pains in your heart or chest?

• Has your doctor recommended medication for your blood pressure/heart?

• Do you tend to lose consciousness or fall over as a result of dizziness?

• Do you have a bone/joint problem that could be aggravated by exercise?

• Have you suffered from any injuries which are aggravated by exercise?

• Are you or could you be pregnant?

• Are you aware, through your own experience or a doctor’s advice, of any other physical reason against your exercising without medical supervision?

If you answered YES to any of the above questions, please consult your GP and if approved to take part, please give medical details in advance of your first class to your instructor, or by e-mail to admin@adventurecircus.org.

First aid and new injuries or medical conditions

Our instructors are emergency first aid trained and at all classes, are in possession of a first aid kit, with access to ice packs. If you have been diagnosed with a new medical condition or have sustained an injury then it is your responsibility to discuss your participation with your GP before coming back to class, and the instructor before the class begins.

Drugs, alcohol, smoking, tobacco and chewing gum policy

Adventure Circus has a zero tolerance policy towards the use of recreational drugs, alcohol, smoking, tobacco product use and chewing gum in classes. If it is thought that you are under the influence of alcohol or drugs you will be asked to leave the class. You will also not be able to complete your course with us and you will not be able to apply for a refund or claim from us any costs, travel costs or other compensation.

Nut allergy advice

One of our instructors has a severe nut allergy, and so it is forbidden to bring or consume nuts or nut products in the gym. If you have an allergy that we should be aware of, then please note this on your new start form.

Equality, welfare and child protection

Adventure Circus instructors are aware of and have received training in the Equality Act 2010 and wherever possible Adventure Circus will allow full participation from all members of society, provided they meet the physical activity readiness requirements outlined above. Our instructors have completed a protection of vulnerable groups (PVG) check and are members of the scheme. Our instructors are also encouraged as soon as possible to attend Safeguarding Children training courses. We have a welfare and child protection policy and it is possible to receive a copy on request by emailing admin@adventurecircus.org. Our welfare officer is Emma Byrne and she can be contacted in confidence via emmamb51@gmail.com or 07788 733512 (phoning preferred). Parents of young participants are encourage to read the information available from sportscotland with regards to Positive Coaching Scotland and Understanding Talent.

Spectators and Photography

Since Covid-19 we have had to reconfigure our training space and unfortunately spectating is no longer possible. We do have opportunities throughout the year for guests to see progress of children in classes.

Photography is permitted in classes for age 14+, but if you are taking photographs of someone other than yourself, you must have that person’s permission to take/store/share their image. In taster classes, it is possible for spectators to take photographs of their children, but not of other people’s children.

Adventure Circus reserve the right to take photographs and video footage of class participants for the purposes of skills development, instructor training and class promotion via print, social and web media. If you do not consent to your image or your child’s image being used, please email admin@adventurecircus.org.

Behaviour

Adventure Circus reserves the right to terminate your booking with us if your behaviour is likely in our opinion to cause distress, damage, danger to person or property; annoy other customers, employees or our partners. Please also see our policy above on Drugs and Alcohol. Booking terms and conditions Confirmation of booking: bookings made online, verbally or by email are not final until payment is received in full at your first class.

Missed class and make up class policy

It is possible to make up a missed class within the block you are booked in, or in the subsequent block, as long as you are booked in again. 24 hours notice is required to change your class and only if space is available in the replacement class can you attend the make up class. You must notify us verbally, by email to admin@adventurecircus.org or by text to 07709815564.

If you miss a class, you can 'make it up' at another suitable class during the block.

Suitable would be

Trapeze - make up at another trapeze class or a hoop class

Silks - make up at another silks class

Hoop - make up at another hoop class or a trapeze class

Rope - make up at cloud class or at Tuesday 8pm (it is silks but I will put up a rope)

Cloud - make up where ever you please! Cloud is a bit of everything!!

If you miss a class at the end of your block, you can make up the class in another class in the new term, so long as you are booked back in for another block of something.

You can offer to swop with someone but if you can't get a swop, rather than just give your class away, then you can do a make up class.

If you give away your class for free or sell your class to someone then you can't then make up the class as someone will have taken that class credit.

To make up a class, just look at the class you wish to go to - do this by checking out the online shop and click on the tile for silks / hoop etc, see who takes the class and then ask the teacher if there is space to attend.

Unfortunately due to class sizes being at their capacity, it is not possible to make up circus kids / juniors / teens classes.

Please note, open training sessions can not count for make up sessions.

Changes and cancellations by us

While every effort is made to ensure that your course commences as planned, Adventure Circus reserves the right to cancel or revise any course as necessary. If a course is cancelled, students will be notified and all payments refunded in full or a suitable alternative course offered.

Open training

Current students and visiting former students must work within their skill level at all times during open training. Sessions are supervised, but are not taught classes so students will not be taught moves, and learning from Instagram / YouTube is not allowed. Students are also not permitted to teach other students moves that they know, but the other student does not know during an open training session in case of becoming trapped, suffering a fall and / or injury, and out of respect for the Adventure Circus staff who take time to plan lessons and deliver sessions tailored to the ability of all students.

Open training attendees should respect the practise time of all individual students and not encroach on their practise time to allow focus. It is however possible for people to arrange to train together to work on common goals. We recommend that this is arranged in advance of open training. By attending an open training session you agree to abide by the rules of open training.

Professional training

Visiting professionals are welcome at Adventure Circus. You must have professional insurance that is valid and will be asked to show a copy at sign in. You can bring your own equipment, but it must be from a reputable supplier, not broken/damaged and you must be able to explain how/when your kit is independently inspected. You must work within your own limits at all times and use crash mats provided.

Carnival Weekender

We are so happy to organise Carnival because we know that you, our students are wonderful. Please though read and follow these rules for participation in Carnival so that we can all have a good time

  • Carnival is a celebration of togetherness and we will be promoting happiness and respect for each other, so please be kind

  • Minimum age is 16 years. Under 18s require parental permission which we will seek upon sign up

  • Please tell us your diet / participation requirements. We are NUT FREE so that we don’t trigger any allergies

  • Please help us out where-ever you can, such as ‘mucking in’ and taking rubbish home / taking your camping stuff home. You can also help if you see us in need of help, and if specifically asked by a member of the AC team

  • Tents to be pitched at least 3m apart (this is the law at campsites for groups apparently)

  • Please no smoking/vaping on site, we are all about fitness and it is bad for you

  • For under 18s there is a zero tolerance rule for the consumption of alcohol. If this rule is broken parents/guardians will have to collect children from our site. For all over 18, alcohol in moderation is permitted, but not during workshop time. If our instructor team believe that you are under the influence of alcohol / hungover then we will stop your participation in our workshops for your own safety

  • There is also a zero tolerance rule for illegal drugs and any conduct that makes your fellow participants feel uncomfortable e.g drunk, disorderly or abusive behaviour

  • Your personal possessions are your responsibility, please look after them

  • We will have a camp fire, so don’t start your own at the camping site. Also please no Chinese lanterns / fireworks etc! No open fires of any sort inside your tent/pod due to the high risk of carbon monoxide poisoning

  • Please don’t stray into neighbouring land / fields / buildings / climb walls or do anything else that will result in a complaint and spoil our fun

  • Any accidents / injuries must be reported asap to the daily duty team so we can deal with them / log them in our accident record

  • We cannot accept any responsibility for injury sustained while participating in workshops / free time / camping. Please follow our warm ups and take part within your limits and let us know if you have any injury/illness which might affect your participation, and in your free time please don’t go crazy, just chill/relax

  • Our campsite is located in a rural environment, and so we do not accept responsibility for any damage, injury or inconvenience caused by livestock, plants, trees, wildlife or weather. We advise you to have the relevant insurance to join us / take part

  • We shall not be responsible for any losses that you suffer that are indirect or not foreseeable, including, but not limited to, loss of income or revenue, loss of business and loss of anticipated savings

Carnival Watersports

For those who visit Loch Morlich with us, we will have safety craft with us (stand up paddle boards - min 3) but you must follow these additional rules

  • Any SUPs / Kayaks you bring must be water worthy

  • Swimmers must be confident in the water and you must bring/wear a tow float/buoyancy aid to help you in case you get into difficulty

  • There are no changing facilities so please bring a big towel or dry-robe type garment to change on land


Refund Policy


Kids / Juniors / Teens classes : refunds only in exceptional circumstances
Age 14 + / adult aerial: see make up policy above
Hula hoop: no refunds available
Summer school: no refunds available
Tasters: no refunds available
Workshops: where a deposit has been paid, this is non refundable
Birthday parties: where a deposit has been paid, this is non refundable
Private lessons: no refunds available but can be rebooked
Carnival: no refunds but you can sell on your place to another AC student

In all cases, it is possible to transfer your booking to another person or party who you have sourced (e.g. a friend or family member). You must give us 48 hours notice to transfer your booking over. If injured, it is possible to transfer your booking to the next block of classes, but this depends on the severity of the injury and proof (doctors note may be required). Gift voucher / charity donation experience

Vouchers all list expiry dates and must be used / redeemed in line with the date noted. In order to avoid disappointment, we recommend that you redeem the voucher well in advance of the expiry date and do not organise travel until the booking has been confirmed in writing by us. If you need to cancel or reschedule your booking, you must inform us by emailing admin@adventurecircus.org and propose a new date, which must be within the experience validity date. If we cannot accommodate your new date, then no refunds will be given. If we have to cancel / reschedule then the validity period will be extended to accommodate a new date and no refunds will be given.

Family / group experiences must have a responsible adult present (age 18+). Private lessons for one or two people are for ages 8+. Gift vouchers / charity donations / competition prizes have no alternative cash value and cannot be exchanged, re-sold, transferred, refunded or extended past the expiry date.

Personal Risk / Insurance

The undertaking of our activities may involve some personal risk and you will have to sign that you agree to participate (or have the signature of a parent/guardian).

Some personal insurance policies may not cover some of our activities. Please check with your insurer well in advance of your experience. Participants must comply with specified safety procedures.

Please listen and take note during classes - it is for your own safety. Reminder - any persons deemed under the influence of drugs or alcohol will not be permitted on site.

Data Privacy

Your personal information is very important to us and we urge you to read our privacy policy which came into effect 25 May 2018. Pre 25 May 2018, by signing up for a class, workshop, or performance ticket, we will add your name and email address to our mailing list and you have the right to unsubscribe at any time. We will only send you information about Adventure Circus classes, performances, special offers, merchandise, workshops and general circus news. Our full privacy policy can be viewed here.

Copyright

While we are fully aware we did not invent circus and aerial acrobatic skills and associated movements, all class formats, original choreography and written materials (including instructor notes, photography, web content and newletters) remain the property of Adventure Circus and may not be reproduced outside of classes, workshops or performances in any way without the written permission of Adventure Circus.

Disclaimer

By booking classes, an open training session, a workshop, taster session, party or private lesson you are confirming that you have read and understood these terms and conditions. By paying the class fees and attending a session you take responsibility for any injury you or your child sustains and understand that you or your child participate in our circus classes at your own risk.
